Limitation of Liability

The products of Maran Creations by MyStates must be used exclusively in accordance with their intended purpose and in full compliance with the corresponding instructions for use, safety, care, and maintenance.

The use of any product implies that the user has been informed of the relevant instructions, warnings, reservations, and limitations of liability concerning the product category.

The company bears no responsibility for damages, wear, injuries, accidents, losses, or any other consequence arising, indicatively, from:

• use of the product contrary to the instructions,
• use of the product for a purpose other than the intended one,
• use without the required supervision,
• use by children or access by children to the product without adult supervision,
• use near children, pets, flammable materials, heat sources, or unsuitable surfaces,
• poor, improper, careless, or unsafe use,
• dropping, impact, breakage, pressure, deformation, or mechanical stress of the product,
• incorrect placement, insufficient support, unsuitable hanging, or use of unsuitable bases, hooks, supports, or surfaces,
• exposure to moisture, water, sun, high temperature, frost, dust, chemicals, perfumes, cosmetics, or other external factors,
• normal wear due to time, use, or environmental conditions,
• alteration due to improper storage, cleaning, transport, or maintenance,
• intervention, modification, repair, disassembly, or reuse of the product by the user or a third party,
• use of a product that already shows visible wear, cracking, breakage, alteration, instability, or any indication of an unsafe condition,
• use of the packaging, container, base, or individual component of the product in a way different from the intended one,
• failure to promptly discontinue use when a potential problem or indication of risk appears.

The user is solely responsible for selecting an appropriate space, surface, base, method of placement, conditions of use, and conditions of storage of the product.

The company is not liable for any damage to furniture, fabrics, floors, walls, surfaces, objects, personal belongings, professional premises, or third parties, insofar as the damage is connected with improper use, placement, storage, transport, or non-compliance with the instructions.

For products that include glass, metal, wax, fragrance, small components, sharp points, fragile parts, or decorative elements, the user must take increased safety precautions. The company is not liable for injuries or damages resulting from breakage, cutting, swallowing, contact, dropping, or improper handling of the individual components.

Any allergic, respiratory, skin, or other individual reaction to fragrance, metal, color, wax, material, or individual ingredient does not necessarily constitute a defect of the product and does not establish liability of the company, insofar as it is due to the user’s individual sensitivity.

The company’s liability is limited exclusively to cases of proven actual defect of the product at the time it is made available, in accordance with applicable law.

If the user considers that the product presents a defect or a potential safety issue, use must be discontinued immediately, and the product, its packaging, and the proof of purchase must be retained, while the company is contacted with a clear description and photographic material.

The company reserves the right to request the return or inspection of the product before any replacement, refund, compensation, or other action.
